Land transfer tax, explained
Land transfer tax is usually the largest cheque on closing, and it is where first-time buyers and Toronto buyers see the biggest swing.
Up to $4,000 back from Ontario
If every buyer qualifies, Ontario refunds up to $4,000 of its land transfer tax. That covers the whole provincial tax on a home up to about $368,000. Buying in Toronto, the city refunds up to $4,475 of its tax as well. The refund can be claimed when the transfer is registered, so it comes off the tax you pay on closing; otherwise you apply to the Ministry of Finance within 18 months. If only one of you qualifies, the refund follows ownership: a 50% owner gets up to $2,000 from Ontario.
You pay land transfer tax twice
Inside the City of Toronto you pay Ontario’s land transfer tax and Toronto’s municipal land transfer tax. The rates are the same up to $3 million, so a $1,000,000 home costs $16,475 in Ontario tax plus $16,475 in Toronto tax: $32,950 in all, against $16,475 in Aurora, Newmarket or Vaughan. Since April 1, 2026, Toronto charges 4.4% to 8.6% on the part of a price above $3 million.

Questions about the quote
Is the legal fee in this quote my final fee?
For a standard file, yes. It is our published flat fee with HST, and it is the figure in your written estimate. Private lenders, estate sales, more than one property, additional mortgages on a purchase, new builds and files received within five business days of closing are quoted in writing instead.
How is land transfer tax calculated?
Ontario charges land transfer tax on the purchase price at 0.5% up to $55,000, 1% up to $250,000, 1.5% up to $400,000, 2% up to $2 million and 2.5% above $2 million for a home. The City of Toronto adds a municipal land transfer tax at the same rates up to $3 million and higher rates above that. First-time buyers can get up to $4,000 back from Ontario and up to $4,475 from Toronto.
Who counts as a first-time buyer?
For Ontario’s refund you must be at least 18, a Canadian citizen or permanent resident, have never owned a home or an interest in one anywhere in the world, and move in within nine months. If your spouse owned a home while you were together, neither of you qualifies. When only some buyers qualify, the refund is shared by their ownership percentage. Toronto’s rebate has its own similar test, and we confirm both on your file.
What if a buyer isn’t a Canadian citizen or permanent resident?
Ontario’s Non-Resident Speculation Tax of 25% may apply on top of land transfer tax. This estimate does not include it. Tell us on the call and we will confirm whether it applies.
