Purchases
Freehold purchase
We review your Agreement of Purchase and Sale, conduct a full title search, coordinate with your lender, prepare the Statement of Adjustments, and register the deed and mortgage electronically on closing day — followed by a full reporting letter with all documentation.
Condominium purchase
Everything in a freehold purchase, plus a thorough review of the status certificate — the document that reveals the financial and legal health of the condo corporation before you are committed. One of the most overlooked steps in a condo purchase; we treat it seriously.
New build & pre-construction
Contract review, occupancy closing, and final closing. Engage us before you sign with the builder — we flag problematic clauses, Tarion warranty implications, and closing costs builders bury in schedules. Each stage is a separate engagement with its own flat fee.
Assignment of purchase agreement
Selling or buying a contractual interest before closing — typically a pre-construction unit. We review the assignment agreement, advise on HST implications, and ensure the builder’s consent requirements are satisfied, acting for either side.
Sales
Residential sale
We prepare your title for transfer, coordinate the discharge of existing mortgages, prepare and review the Statement of Adjustments, and ensure closing funds are received and disbursed accurately. Net proceeds are in your hands on closing day.
Mortgages & title
Mortgage refinance
Switching lenders or pulling equity out — we receive and review your lender’s instructions, discharge the existing mortgage, and register the new one. We ask for lender instructions at least 7 business days before closing for a smooth transaction.
Mortgage discharge
Paid off your mortgage? We handle the discharge registration with the lender and file it on title. A clean title is a protected title.
Private mortgage
Private financing operates outside the traditional banking system and carries distinct legal considerations. We review the mortgage commitment, advise on terms, and ensure the transaction is properly documented and registered.
Title transfer
Transfers between spouses, adding or removing family members, gifting, and estate-related changes — each involving a title search, preparation of the transfer deed, and registration. Title changes often intersect with estate planning; we handle both sides.
Survivorship application
When a joint tenant passes away, the survivor acquires their interest automatically — but the transfer must be formally registered. We prepare and file the survivorship application so the registry reflects current ownership and estate administration is not delayed.
Interprovincial closing
Ontario-based clients purchasing property in another province sometimes need Ontario counsel for document execution, independent legal advice, or coordination with out-of-province lawyers. We provide that support as a flat-fee service.

Title search and requisitions, zoning and official plan compliance, PPSA and corporate searches against the vendor, and title insurance. We draft or review the closing documents, coordinate with lenders, and close cleanly — office, retail, industrial, mixed-use, and income-producing properties across the GTA.
Transfer to corporation
Moving personally held commercial property into a corporation for liability, estate, or tax structuring. We handle the conveyancing and — where the deal involves a rollover under the Income Tax Act — coordinate with your accountant and our own corporate practice so the legal and financial pieces align.

Custom lease agreements drafted from scratch — not a generic template — covering rent structure, permitted use, exclusivity, renewal options, tenant improvement obligations, and termination rights. Subordination, non-disturbance, and attornment agreements included where required.
Lease review

More than signing a commitment letter. We review lender loan agreements, advise on security documents, and make sure financing terms are clearly understood before funds advance — conventional commercial mortgages, term loans, and construction financing, coordinating directly with your lender’s counsel. Frequently asked questions
What does a real estate lawyer actually do?
In Ontario, a lawyer is legally required on a property transaction — only a licensed lawyer can register the transfer and mortgage on title through Teraview, the province’s electronic land registration system. Beyond registration, we review your Agreement of Purchase and Sale, conduct a full title search to uncover liens, easements, and encumbrances, raise requisitions with the other side, arrange title insurance, prepare the Statement of Adjustments, receive and disburse closing funds through our trust account, and report to you and your lender afterward.
Do I have to pay anything up front?
No. Barbarian Law® runs specific retainers, not evergreen retainers: your flat fee is published and confirmed in writing before we open the file, and you’re invoiced when the work is done — on a purchase, closing funds and fees are settled through the transaction itself, itemized on your Statement of Adjustments and reporting letter. No deposit into trust to get started, no top-ups.
When should I involve a real estate lawyer?
Ideally the moment your offer is accepted — and for pre-construction, before you sign the builder’s agreement. Early involvement gives us time to search title, satisfy conditions, and resolve requisitions without closing-day pressure. For refinances, we ask for lender instructions at least 7 business days before closing.
How much will my closing cost?
At Barbarian Law®, residential purchases start at $1,500 + HST for a cash purchase and $1,650 + HST with a mortgage; a residential sale is $1,500 + HST and a refinance is $1,250 + HST. Commercial transactions under $1 million start from $2,500 + HST. On top of legal fees, budget for disbursements — deed registration ($84.23), mortgage registration ($84.23), the closing software fee ($50.85), title insurance, which varies with property value, and land transfer tax. How long does a real estate closing take in Ontario?
The closing date is set in your Agreement of Purchase and Sale, and is typically 30 to 90 days after the offer is accepted on a resale property. The legal work runs across that whole window rather than on closing day itself: title searching and requisitions happen early, lender instructions and the Statement of Adjustments come together in the final weeks, and the transfer and mortgage are registered electronically on the closing date. We ask for lender instructions at least 7 business days before closing, and a rush fee applies to residential files received with fewer than 5 business days to closing.
Can a first-time buyer get the land transfer tax rebate in Ontario?
Yes, if you qualify. Ontario refunds up to $4,000 of provincial land transfer tax to eligible first-time buyers, and Toronto offers a separate municipal rebate of up to $4,475 on properties within the city — up to $8,475 combined. Eligibility is strict: you must be a Canadian citizen or permanent resident, at least 18, occupy the home as your principal residence within nine months, and neither you nor your spouse can have owned a home anywhere in the world. We claim the rebate at registration, so in most cases you never pay the refundable portion in the first place.
Do you handle closings outside the GTA?
Yes. Ontario closings are registered electronically through Teraview, so we regularly act on files across the province — and we provide interprovincial closing support for Ontario-based clients buying in other provinces.
Can you help with the corporate side of a property deal?
Yes — that is the advantage of a transactional firm. Transfers to corporations, share and asset purchases that include real property, and financing all connect to our corporate practice, so nothing falls between two law firms.
Should I update my will when I buy property?
It is one of the best times to do it. A new home is usually the largest asset in your estate, and how title is held decides what happens to it on death: property held in joint tenancy passes automatically to the surviving joint tenant outside your will, while property held as tenants in common or in your name alone passes under your will — or, if you don’t have one, under Ontario’s intestacy rules. Do you take real estate disputes or litigation?
No — we are a transactional firm and we stay in our lane. If a dispute arises, we refer you promptly to a trusted litigation specialist, hand over whatever background the file requires, and can continue acting as your transactional counsel alongside them.
